Your Choix Terms and Conditions

These terms and conditions, in conjunction with any documents referred to within them, informs you, the customer the terms and conditions on which you may use our website www.yourchoix.com (the website) and on which we supply any of the products on our site to you.

Please read carefully and make sure you understand them, we may change the terms and conditions from time to time so please check back every so often (any changes made to the terms and conditions after the placement of an order will not affect that order unless we are required to make that change by law) – any questions, please ask via the email address below or by calling 01536 738 849.

You should understand that by using our site and services, you agree to these terms and conditions. Please also note that if you do not agree to these terms and conditions, you will not be able to use our website, or services.

Definitions:

In these terms and conditions “We”, “Our” and “Us” means Your Choix Limited, a limited company registered in England and Wales with company number 10994969. “You”, “Yourself”, “The Member”, “The Buyer” means any user of the website including any user who makes a purchase via the website.

1. Privacy Policy:

Our privacy policy tells you how we gather data and how we use it. By submitting your personal data on this site, whether in fields marked mandatory or otherwise, or via telephone, email or whatsapp or any other means of communication utilised by our stylists and yourself, you are affirming your consent for such information to be used in accordance with this privacy policy. You are able to withdraw your consent at any time via contact details provided on the website or through your personal stylist.

2. Registration and Access to our site

To use any of the services provided by Your Choix Limited, online or otherwise, you will need to register. Registration will comprise of us taking some personal details from you, so we can tailor your experience with Your Choix. If the initial information should change throughout your use of Your Choix Limited services, you can change that information at any time via the website or via the stylist and preferred method of communication.
Your login details including your password should be unique and kept secure, you must notify us immediately if there has been any breach of security or unauthorised use of your account.

On registration you will be asked to complete a questionnaire about yourself, this will include questions such as style and lifestyle choices, colour preferences, your size and fit etc. this information helps us to provide you with a more personalised experience, please make sure that the information provided for both your principal account and your family accounts is true and accurate at the time of entry and kept up to date via the site or via your stylist.

Access to our site is permitted on a temporary basis, we reserve the right to withdraw or amend the service we provide on our site without notice. We will not be liable if, for any reason, our site is unavailable at any time or for any period.

If you choose or are provided with a user ID code, password or any other piece of information as part of our security processes, you must treat such information as confidential between us and you without disclosure to any third party.

We reserve the right to disable any password or code at any time if we are of the opinion you have failed to comply with any of the terms and conditions.

3. Eligibility to purchase

In order to purchase via Your Choix, you will be asked for personal information upon registration. This will include your name, your phone number and email address and payment details along with other requested information. By completing this information, you are confirming that the payment card belongs to you or you have the explicit permission of the cardholder to use it. At this stage you may be subject to a fraud check by a third-party company, this will not affect your credit rating.

4. Intellectual Property rights

All content on the website belongs to Your Choix Limited and must not be replicated or modified in any way for commercial purposes without explicit written consent from Your Choix Limited.

5. Prices

Your Choix Limited sources stock from around the world and therefore may only have the local recommended retail price available for a certain product, we may convert this recommended retail price to GBP at the time of purchase by us or at the time of sale to you. You will be able to see these retail prices upon the despatch of the Your Choix Case on the website within your personal account. The cost and percentage discount off retail price will be worked off the converted recommended retail price.

We carry a large number of products and unfortunately it is possible that there may be some that are marked with an incorrect recommended retail price. We make sure the prices are verified to the best of our knowledge prior to dispatch.

Payments for all orders must be made with a credit or debit card. We do not accept any other method of payment.

6. Terms of Sale

Outline of the process:

You will complete a questionnaire for yourself and for your family members or partner on the website, via email, over the phone or via another preferred method of communication with your stylist.

Your stylist will then make a selection of products that could include clothing, accessories, bags and footwear based on your personal profile, they will then arrange with you a delivery for the Your Choix Box.

You will receive a box of products that your stylist has curated for you to try on at home, once delivered, the products are your responsibility until the point of return. Any product returned to us must be in 100% resalable condition, in its original packaging and with all original swing tags and labelling. Any product returned to us that is not in 100% resalable condition will be charged to the card details provided.

The list of products supplied in the box will be made available to you on the site, where you will be able to see the recommended retail values in GBP. On this page you will be able to select the products you wish to keep and leave the products you wish to return blank. Through this, the site will estimate the percentage of recommended retail price the chosen items will cost you to keep.

Product price includes vat and are subject to change if vat rates change until goods are purchased in full.

You will be responsible for dropping off your unwanted products to your local Collect + drop off point within the allowed time-frame, there is no charge to you for this service, delivery and returns are free of charge.

Once you have finalised your order, you will be charged for the items chosen to the saved payment details. Once your Your Choix Returns box is received, we will check the products on return, if they are no longer in resalable condition, you will be notified by email and charged to the saved payment details on your account.

If you receive your Your Choix Box with a damaged product on arrival, you must notify your stylist of this immediately, if you do not notify the stylist immediately there is a chance you will be charged for damaged returns.

We do not currently accept orders from addresses outside of the UK.

By placing an order on our site, you warrant that

  1. You are legally capable of entering into binding contracts
  2. You are at least 18 years old
  3. You possess a valid credit or debit card
  4. You are a resident in the UK
  5. You are accessing our site from within the UK

The contract is formed between us and you when the Your Choix Box is scheduled for despatch.

Cancellation

You have 14 days from the day of delivery to cancel the agreement for some or all the products provided by Your Choix within you’re your Choix Box and return the products in accordance to our returns policy. This does not affect your other statutory rights.

Liability Disclaimer

The total liability for any claim against Your Choix shall not exceed the price of the goods supplied by Your Choix to the customer. We accept liability for death or personal injury caused by our negligence or willful misconduct, this is not limited by the previous condition.

We will not be liable to you for any indirect or consequential loss, damages or expenses (e.g. loss of profits) save as precluded by law.

If Your Choix fails to comply with the terms and conditions outlined above, we are responsible for loss or damage you suffer as a foreseeable result of us breaching the terms and conditions to the limit of the purchase price. Loss or damage is foreseeable if it is obvious that it will happen or if, at the time the contract is made, both you and Your Choix know it might happen, for example, if you discussed it with us during the sale process.
